Is Surrogacy legal in Mexico?
Currently there are legal procedures so that foreigners can access this figure in Mexico in a completely legal way as long as they meet legal requirements. The Supreme Court of Justice in 2017 recognized that surrogacy is a legitimate, lawful agreement and that it can be remunerated for the surrogate. Also on June 8, 2021, the Supreme Court of Justice of the Nation (SCJN), ruled in favor of surrogacy for foreign families. The SCJN established that third parties, such as agencies or offices, cannot be prevented from participating in surrogacy contracts. In addition to this, the SCJN determined that it is completely unconstitutional that surrogacy contracts are only for Mexicans. Leaving aside foreigners, which means that they are being prevented from exercising their human right to health and family planning, in addition, this directly violates the principles of equality and non-discrimination.
